MINUTES OF THE EXECUTIVE COMMITTEE
OF THE BOARD OF TRUSTEES
OF THE TRUSTEES OF PURDUE UNIVERSITY
January 22, 1990
A quorum of the Executive Committee of the Board of Trustees of The Trustees of Purdue University, such quorum composed of Messrs. Jesse and Powers, convened via telephone conference call at 1:30 p.m. on Monday, January
22, 1990, pursuant to call of Board President Jesse. Treasurer Ford was present in his office in Hovde Hall and participated in the conference call.
Treasurer Ford directed the attention of the Committee to its prior adoption, on January 16, 1990, of a Resolution authorizing designated officers of the Corporation to execute (i) a proposed agreement between the U.S. Environmental Protection Agency and various former users (including Purdue) of the Tippecanoe County Landfill site, relating to EPA's investigation of that site and (ii) an^ addendum to a prior agreement among users of the landfill (including Purdue) regarding division of costs and other matters concerning participation in the EPA proceedings. Dr. Ford pointed out that the Resolution, as adopted on January 16, contained a proviso reading as follows:
Providedp that such execution of said documents on behalf of the Corporation shall be made only upon the prior or simultaneous execution thereof by all of the other former users of the landfill named in said documents, or upon the express condition that such execution on behalf of the Corporation shall not become effective unless and until all of such other named parties have executed each of said documents.
Dr. Ford then reported that the EPA is not willing to extend its unilaterally imposed deadline of January
23, for the signing of the agreement first referred to above (between EPA and former users of the landfill) except as to the City of Lafayette. The City would not legally be able to sign until approval by its City Council, at a meeting proposed for early February; however, the Mayor has announced his intent to obtain such approval, and preliminary approval by the City's Board of Works is anticipated later on this date of January 22.
